IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, INCLUDING A MANDATORY ARBITRATION CLAUSE THAT LIMITS YOUR RIGHTS TO PARTICIPATE IN CLASS ACTIONS.

  1. Introduction: EVE & OAK HOLDINGS LLC, along with its associated entities ELMNTL and ROC DOC (collectively, “ELMNTL”, “we”, “us”, or “our”), operates websites located at www.elmntl.us, www.elmntl.us, and www.liveelmntl.ai (the “Websites”). ELMNTL provides telehealth consultations, functional medicine diagnostics and testing, IV hydration and drips, blood draw services, aesthetic services, and wellness optimization programs exclusively within the State of Ohio. By accessing or using our Websites or services (“Services”), you agree to comply with and be legally bound by these Terms and Conditions (“Terms”). If you disagree with these Terms, you may not use our Services.
  2. Services Offered: ELMNTL offers:
    • Telehealth consultations
    • Functional medicine diagnostics and testing
    • Optimization and wellness programs
    • IV hydration and drip therapy
    • Blood draw services
    • Aesthetic services (including Botox®, dermal fillers, skin lightening, microneedling, laser treatments, and chemical peels)
    • Subscription-based products (supplements, peptides, wellness packages
  3. Eligibility and Availability: Our Services are available only in Ohio to individuals 18 years or older. By accessing our Services, you represent that you meet these eligibility criteria.
  4. Medical Provider-Patient Relationship: ELMNTL employs licensed medical providers, including a medical director and certified nurses. Your use of telehealth services establishes a direct patient-provider relationship.
  5. Pharmacy & Supplement Fulfillment: We partner with pharmacies CR8, MedQuest, Alpha Bio Medical, and Legre for both compounded and traditional medications. Supplements are provided through Thorne, SkinCeuticals, and Nutrafol. We ship products in customized packaging without child-resistant features.
  6. Payment Terms: ELMNTL operates on a cash-only basis but accepts Health Savings Account (HSA) and Flexible Spending Account (FSA) payments for eligible products. Subscription payments are processed two weeks before shipping. All cancellations must be made prior to recurring billing.
  7. Refund Policy: No refunds are provided for telehealth consultations, aesthetic services, medical products, supplements, peptides, or laboratory services.
  8. FDA Disclaimer: Supplements, IV drips, and peptides provided by ELMNTL are intended solely for wellness optimization purposes. These products may be considered off-label or experimental and are not FDA-approved to diagnose, treat, cure, or prevent disease.
  9. Compounding Pharmacy Disclaimer: Some medications provided through compounding pharmacies are customized for physician-directed use and may not be FDA-approved.
  10. Telehealth Consent & Limitations: By using our telehealth services, you consent to electronic communications with our medical providers. Telehealth has limitations compared to in-person care, and not all medical issues are suitable for remote evaluation.
  11. Consent for Peptide and Other Experimental Therapies: You acknowledge that certain therapies provided, including peptides, may be viewed as experimental or controversial. You understand the risks, including possible adverse reactions like injection-site reactions or transient changes in blood sugar levels. Results cannot be guaranteed.
  12. Arbitration & Dispute Resolution: Disputes arising under these Terms shall be governed by Ohio law, with exclusive jurisdiction in Franklin County, Ohio. Arbitration is mandatory, and class action participation is waived.
  13. Privacy & HIPAA Compliance: Your privacy is critical. Please review our separate Privacy Policy and HIPAA Compliance Notice provided separately, which forms part of these Terms.
  14. Third-party Integrations: Our Services integrate with Quest Diagnostics, LabCorp, and the pharmacies listed above. We utilize Konversly CRM for customer relationship management purposes.
  15. Changes to Terms: ELMNTL reserves the right to modify these Terms at any time. Changes become effective upon posting on our Websites.
